Brickanuck rental services by Board Miniatures Hobby Store – Terms of Service

These Terms of Service (“Terms”) govern all rentals, purchases, and interactions with Brickanuck, operated by Board Miniatures Hobby Store (“Company”, “We”, “Us”, “Our”).

By renting a LEGO® set (“Rental Set”), purchasing products, or using our website or services (“Services”), you agree to these Terms in full.

These Terms operate in addition to the Brickanuck Rentals "Rental Waiver", which remains binding and must be accepted before each rental.

1. Definitions

“Rental Set” – Any LEGO® set, kit, bundle, or product provided temporarily for rental use.

“Customer”, “You”, “Your”** – Any individual or organization renting or purchasing from Board Miniatures Hobby Store's Brickanuck rental services.

“MSRP Group Pricing”** – Our pricing model based on the LEGO® set’s Manufacturer’s Suggested Retail Price (MSRP).

“Missing Piece Protection (MPP)” – Optional add‑on that reduces or eliminates charges for accidental piece loss.

“Replacement Cost” – The current market cost to replace missing or damaged LEGO® elements, minifigures, manuals, or containers.

2. Eligibility

To rent from Brickanuck, you must:

- Be at least 18 years old

- Provide accurate contact and payment information

- Maintain a valid payment method for the duration of the rental

- Agree to these Terms and the Rental Agreement Waiver

- Organizations (schools, daycares, clubs) must designate a responsible contact person.

3. Pricing Structure (MSRP‑Based Rental Groups)

Rental fees are determined by the LEGO® set’s MSRP and assigned to one of six main groups:

- Group 1 (Up to $39.99) rental fees of $10 for first 30 days;

- Group 2 ($40 to $79.99) rental fees of $15 for first 30 days;

- Group 3 ($80 to $149.99) rental fees of $29 for first 30 days;

- Group 4 ($150 to $249.99) rental fees of $50 for first 30 days;

- Group 5 ($250 to $499.99) rental fees of $98; and,

- Group 6 ($500+) variable rental fees based on set (25% of MSRP)

After 30 days: A daily two percent (2%) base price charge rate applies indefinitely until the set is returned or deemed lost/stolen.

Rental Sets are automatically, without prior notice, deemed stolen after a period of one hundred and eighty days (180-days) without any contact from the customer and is subject to additional charges up to the full MSRP value of replacing the set in addition to the contractually obligated rental charges.  

Prices may be updated periodically to reflect changes in The LEGO® Group's MSRPs or market availability.

4. Rental Limits

- Only one (1) Rental Set may be rented per customer at a time. Additional sets in the same order will be cancelled and refunded.

- We may refuse service to customers who, at our sole discretion, repeatedly return sets unreasonably late, damaged, incomplete, or contaminated.

5. Probation Period

- The probation period helps ensure a smooth rental experience for both the customer and Brikanuck by confirming account stability, return reliability, and proper handling of rental items.

- All new customer accounts are subject to a probation period lasting a minimum of three (3) months and/or three (3) successful rental cycles, whichever occurs later.

- A rental cycle is considered successful once the rented set has been returned on time, in acceptable condition, and without outstanding balances.

5.1. Rental Access During Probation

- During the probation period, customers are limited to renting available sets in the categories of $50 or below (Groups 1 through 4).

- Access to higher‑value groups becomes available only after the probation requirements have been fully met.

5.2. Orders Placed Outside Authorized Limits

- Any order submitted for a set outside the customer’s authorized rental limits during the probation period will be automatically cancelled.

- Customers will be notified and invited to select an eligible set within their current access level.

5.3. Completion of Probation

- Once the probation period is successfully completed, customers gain full access to all eligible rental groups and sets in accordance with the general rental terms and conditions.

6. Condition of Rental Sets

We promise and guarantee that all Rental Sets are:

- Comprised of official LEGO® components only

- Professionally cleaned

- Inspected for completeness

- Packaged with required components (bricks, minifigures, manuals, containers) Minor cosmetic wear is normal and does not affect rental eligibility.

7. Customer Responsibilities

You agree to:

- Handle all pieces with care

- Supervise young children during use

- Keep the set away from pets, liquids, smoke, and contaminants that could damage parts or the set.

- Return all components in the original container

- Follow all cleaning, handling, and packing instructions

- Notify us promptly of missing or damaged pieces

***Failure to follow these responsibilities may result in additional charges.***

8. Missing, Damaged, or Contaminated Pieces

8.1 Limited Missing Piece Protection (Optional Add‑On). MPP covers accidental loss of small pieces. If you decline MPP, you may be charged:

- Replacement cost of missing pieces

- A service fee for sorting, reconditioning, and restoring completeness

- The MPP only covers limited pieces, any suspected abuse or fraudulent behavior will automatically void the protection and its fees. In this instance, the MPP fees will not be reimbursed and you may be subject to additional replacement fees.

8.2 Damage Beyond Normal Wear

Charges may apply for:

- Chewed, crushed, melted, or stained pieces

- Broken or cracked elements

- Damaged or missing minifigures

- Damaged manuals or containers

- Stickers, glue, markers, adhesives, or modifications

8.3 Contamination Fees

Additional charges may apply for sets exposed to:

- Smoke, Strong odours, Food residue, Pet hair or dander, Liquids, Mold or mildew

- Any substance requiring deep cleaning or part replacement

8.4 Replacement Value

If a set is returned with excessive loss or damage, or not returned at all, you may be charged up to the full replacement value in addition to your rental charge obligations.

9. Returns & Lost or Stolen Fees

9.1 Return Requirements

Rental Sets must be returned:

- Using the provided return instructions

- In the original container

- With all included components

9.2 Late Fees

We do not charge traditional late fees. Instead:

- The flat rental rate covers the first 30 days

- After 30 days, a two percent (2%) per day charge applies until the set is returned

9.3 Failure to Return

If a set is not returned within one hundred and eighty (180) days, without any customer communications or expressed interest in extending the rental period, it may be considered lost or stolen and will be subject to full replacement value charges in addition to any rental charge obligations. If a set is considered or deemed Stolen, legal proceedings may also be initiated.

10. Programs & Alternate Purchase Options

10.1 Return & Receive Program (RRP)

- The Return & Receive Program (“RRP”) allows customers to rent a set, evaluate it, and subsequently purchase a brand‑new sealed version of the same model at a discounted rate.

- When a customer elects to purchase the set, the rental fee previously paid is deducted from the purchase price.

- To complete an RRP transaction, the rented set must be returned in acceptable condition as determined by Brickanuck. Upon receipt and inspection, Brickanuck will ship a sealed version of the same model to the customer.

- Only eligible sets qualify for the RRP. Availability of sealed sets is not guaranteed and may vary based on demand, restock schedules, product lifecycle, or product discontinuation.

10.2 New Sealed Sets (NSS) Add-On

- Brickanuck is a service operated by Board Miniatures Hobby Store, an authorized LEGO® retailer and certified reseller. Customers may request a new sealed set as an add‑on to their rental order (“NSS Add‑On”).

- When available, the sealed set will be included in the same shipment as the rental for convenience.

- All NSS Add‑Ons are subject to stock levels, demand, and product discontinuation. Brickanuck reserves the right to decline or modify NSS Add‑On requests at its discretion.

10.3 Trade-In Program TIP

- The Trade‑In Program (TIP) allows customers to offer their old and/or unused LEGO® sets in exchange for store credits.

- All trade‑ins require prior approval from Brickanuck.

- Only official LEGO® products will be considered regardless if the an off-brand product is compatible with the LEGO® brick system or not.

- Credit values are determined based on factors including, but not limited to, condition, completeness, market demand, and Brickanuck’s current inventory needs.

- Trade‑in eligibility is not guaranteed. Brickanuck may decline any trade‑in for any reason, including but not limited to poor condition, incomplete sets, low demand, or operational considerations.

- Prior approval in writing is required before a trade-in is considered legitimate. Sending your set to us does not constitute approval of a trade-in.

10.4 End-of-Life Sets (EOL Sets)

- From time to time, Brickanuck retires sets from active rental circulation. These End‑of‑Life (“EOL”) sets may be offered for purchase at discounted rates.

- EOL sets are sold strictly “as‑is” and may show signs of use consistent with their rental history.

- Availability is limited and offered on a first‑come, first‑served basis. All EOL sales are final.

10.5 General Alternative Purchase and Program Eligibility Notice

- Some sets may or may not qualify for purchase under any program due to demand, restock availability, product discontinuation, or other operational reasons. Brickanuck reserves the right to approve, decline, or modify any purchase request at its sole discretion.

11. Health & Safety

- All sets are cleaned using mild, non‑toxic agents in accordance with internal sanitization SOPs.

- Customers must NOT clean sets using any detergents with dyes, perfumes, harsh chemicals, heat, dishwashers, or other damaging methods. Any evidence of non-approved cleaning agents may result in full replacement value charges in addition to standard rental charge obligations.

- We clean every set between rentals; home cleaning is not required.

12. Retail Sales

Retail products offered at checkout or online at full value (sealed sets, minifigures, accessories) are sold separately and are not part of the rental program. Retail purchases follow the policies of Board Miniatures Hobby Store.

13. Gift Cards & Credits

- Gift cards are non‑refundable and expire after 48 months unless required by law.

- Credits or promotional balances have no cash value.

14. Conduct & Misuse

It is strictly forbidden and you agree not to:

- Resell, lend, or sub‑rent Rental Sets

- Use sets for commercial events without written permission

- Misrepresent damage or loss

- Engage in abusive or fraudulent behaviour

Any violations may be subject to full replacement costs in addition to rental charge obligations. We may suspend or terminate accounts for violations.

15. Liability & Disclaimers

- LEGO® is a trademark of the LEGO® Group, which does not sponsor or endorse Brickanuck.

- Brickanuck rental services and Board Miniatures Hobby Store are not responsible for injuries resulting from improper use of LEGO® products.

- All rentals are provided “as‑is” except as expressly stated.

- To the fullest extent permitted by law, our liability is limited to the amount paid in the preceding 90 days.

16. Governing Law & Court Proceedings

- These Terms, and any dispute, claim, or legal proceeding arising out of or relating to Brickanuck or Board Miniatures Hobby Store, shall be governed by the laws of the Province of New Brunswick and the federal laws of Canada applicable therein.

- Unless otherwise required by applicable Canadian law, all disputes, claims, actions, or legal proceedings must be brought exclusively before the provincial or federal courts located in New Brunswick, which shall serve as the primary venue for all legal matters involving Brickanuck.

- By accessing or using Brickanuck’s services, customers irrevocably agree to:

  • submit to the exclusive jurisdiction of these courts,
  • waive any objection to jurisdiction or venue, and
  • waive any claim that such courts constitute an inconvenient forum.

- Brickanuck reserves the right, at its sole discretion, to enforce its rights or initiate proceedings in any other jurisdiction where such action is deemed necessary to protect its operations, intellectual property, or business interests.

17. Privacy

We collect and store customer information for rental tracking, payments, and communication. We comply with Canadian privacy laws including PIPEDA. A separate Privacy Policy provides full details. Please visit www.boardminiatures.ca for our full privacy policy

18. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or website with at least 30 days’ notice.
